AMHA Suspends Horses

Editor’s Note: Effective March 4, 2002, The American Morgan Horse Association has brought charges against Bruce Ekstrom and Ekstrom Enterprises, Inc. and ordered a hearing to be held in Shelburne, Vermont beginning May 13, 2002. Subsequent to this action AMHA has suspended 49 horses pending the outcome of the above hearing. The following is the press release made available by the AMHA.

Based on new unsolicited information relevant to the Chantilly Lace investigation, which was closed in November 1999, the American Morgan Horse Association has brought charges against Bruce Ekstrom and Ekstrom Enterprises, Inc. and ordered a hearing to be held in Shelburne, Vermont beginning May 13, 2002. Subsequent to this action we have suspended 49 horses pending the outcome of the above hearing.

The American Morgan Horse Association, with this new information, contends these horses are improperly registered. No additional information will be release at this time. The AMHA Rules for Hearings and Appeals provide that "interested persons" may appear in person or by counsel and participate in a hearing on charges brought under those Rules, and may appeal the decision of the Hearing Committee that decides the charges. The AMHA has deemed that "interested persons" are those persons or entities who, as set forth in the records of the AMHA, have or have had an interest in a horse whose records may be affected by the resolution of the charges. That is, only those who have or have had a record ownership interest in one of the horses whose records are at issue are invited to and able to attend the pertinent hearing(s). All others may be excluded.

We have been asked to clarify the definition of suspension of a horse and you will find that below. With respect to the AMHA Bylaws and Registry Rules and Regulations and Rules for Hearings and Appeal a suspended horse is not an expunged horse.

Definition:
Suspension of a horse(s) refers to the status of a horse within the Registry whereas the Registry will not process any activity with respect to the records of a horse until the condition creating the suspension is resolved, either by lifting the suspension or otherwise acting with respect to the records.
